SIXTEEN PEOPLE HAVE appeared in the Dublin District Court on various public order related offences and one man has been charged with violent disorder following a second night of violence near the City West Hotel in Saggart, Dublin.

Robert Iafrate (35) was charged with committing violent disorder against public order unit Garda on the 21 October.

Sergeant Shane O’Brien told the sitting judge Paula Murphy that Iafrate was seen on CCTV throwing glass bottles at gardaí, and a traffic cone which landed on one frontline Garda’s head.

He said that Iafrate could be seen standing at a height above the crowd and instructing the crowd, who were being directed to disperse by gardaí, to push forward.

Iafrate’s home, at Slade Castle Court, Saggart, was searched under warrant and gardaí seized clothes, which Sergeant O’Brien said that matched the clothing the man could be seen wearing in various CCTV clips.

He said that Iafrate admitted he was present at the serious public order incident that night, and that he apologised to gardaí questioning him for his role.

Sergeant O’Brien requested for bail to be denied. Iafrate’s solicitor said that his partner, who was present in court and visibly upset, was a full-time carer for their daughter who has autism, and that she would not be able to cope on her own if he was not granted bail.

The solicitor further said that Iafrate had complied with Garda enquiries. 

She added that he is not currently working, but had been due to begin work today.

He was granted bail under a series of conditions, including a surety of €3000 with €1000 to be paid via a cash lodgement by Iafrate, and an independent surety of €5000 with €2000 to be lodged in cash.

Judge Murphy also specified that he is not to take part in any demonstrations or protests, and that he will have to sign at the Rathcoole Garda Station on a daily basis, and abide by a curfew.

He was also told to stay off social media completely as part of his bail conditions.

He is due to appear before the Cloverhill District Court on 30 October via video link.

The other 15 people charged in relation to their participation in the public order incidents which took place over the previous two nights were all granted bail under the conditions that they stay away from Saggart and Citywest, that they do not take part in violent protests, and that they stay away from all IPAS centres.

Several of the people who appeared before the court were of a very young age, and several were from outside of Dublin.

They are all due to reappear in court either later this month or at the start of next month when they will enter pleas, and they are all subject to possible further charges.

They were all granted bail on a bond of €300.

Tom McMechan (65) of Russell Place, Tallaght, appeared in court for loitering in the Citywest Drive area last night and failing to leave when ordered to by a garda, and for using threatening language intended to incite a breach of the peace. 

He was on a bench warrant from a court appearance from last month when he appeared charged with possession of a knife on Cork Street in Dublin on 11 August.

Peter O’Malley (18) of Monastery Walk in Clondalkin appeared in court charged under section 6 of the Criminal Justice (Public Order) Act, with engaging in threatening behaviour with intent to incite a breach of the peace last night at Citywest Drive in Fortunestown Dublin.

He also faces a charge under Section 22 of the Intoxicating Liquor Act. He was granted bail is due back in court next month.

Mircea Varga (38) of Harrington Street, Dublin, faced the same charges. He is not currently working and required a Romanian interpreter in court. He is due to reappear in court on 20 November.

David Noonan (51) from New Oak Estate in Carlow also faced the same charge for engaging in threatening behaviour with an intent to provoke a breach of the peace. He is due back in court on 14 November.

Evan Lydon (23) from Caislean Oir, Athenry, Galway was charged under section 6 for his actions during last night’s rioting at Citywest Avenue in Citywest. He said that he was working, and asked to be assigned a solicitor.

He’s due back in court on 13 November.

Student Bartosz Jarsewski (18), from Park Lane, Maryborough, Portlaoise – who is not currently working and has no income- was charged under the firearms and offensive weapons act for carrying a rock that had a sharply pointed blade in a public place, and separately under the same act for carrying a large rock with intent to cause injury and brandishing it at gardaí.

He was also charged with a public order offence under section 6 for his actions during last night’s rioting at Carrigmore Downs in Tallaght, for resisting a garda’s orders, and for threatening language. 

He is due to appear in court in Blanchardstown next month when a plea will be heard.

Ashley McNally (19) of Marian Grove, Rathfarnham was charged under section 6 for his use of threatening language with intent to incite during rioting last night at Citywest Drive in Saggart. 

Evan Freeman (23) of Drumcairn Green, Tallaght was charged under section 6 for his actions during rioting last night at Citywest Drive in Clondalkin, and for loitering and failing with garda orders to leave the vicinity. 

Mark Farley (44), from Tallaght Stone Centre, Belgard Road in Tallaght, was charged over failing to comply with an order to leave the Fortunestown Lane area last night by a garda who had reason to believe that he was acting in a manner that violates the public order act, and with breaching section 6 of the public order act. 

He also had an outstanding bench warrant from Tallaght Garda Station.

Eamon Cox (29) of Dromcorra Avenue, Dublin, appeared in court charged with a breach of the public order act, and for trespassing on the Parklands Parade Building site in a manner that was likely to cause fear. 

John Cox (58) of Corrig Glen, Portarlington, in Laois, was charged for breaching public order last night in the Fortunestown Lane area of Saggart and for being publicly intoxicated to an extent that he posed a potential threat to himself or others. He told the court that he is currently receiving disability allowance.

Joseph Cox (18) of Gortlar Avenue, Jobstown, Tallaght, appeared charged with using abusive language contrary to the public order act last night at Fortunestown Lane in Saggart, and also for trespassing on the Parklands Parade building site, in a manner that was likely to cause fear. 

Karl Burke (34) of 4 De Sebly Crescent, Tallaght, who told the judge that he is currently receiving social welfare payments, appeared charged with breaching section 6 of the public order act for use of threatening language, and failing to comply with a garda order to leave the vicinity of Citywest Avenue last night. 

Bridget Cash (21) of Boot Road, Clondalkin, was charged for failing to comply with a garda order to leave the Citywest Drive area last night, where she was believed to be loitering. 

Sean Comeford (23) of Skeffington Meadows, Tallaght, appeared charged with breaching section 6 of the public order act in the Citywest Drive area of Saggart last night, and for loitering and failing to comply with a garda order to leave.
